Please read these Terms of Service carefully before using Culture Fit Dallas services. By accessing our website or purchasing a subscription, you agree to be bound by these terms. If you do not agree, do not use our services.

1. About Culture Fit Dallas

Culture Fit Dallas ("CultureFit," "we," "us," or "our") is a fitness coaching and training service operated by Pierre Brown in Dallas, Texas. We provide online and in-person strength and weight loss programs through monthly subscription plans.

2. Eligibility

By using our services, you represent that you:

  • Are at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Are not prohibited from using our services under applicable law

If you are under 18, you may only use our services with the express consent and supervision of a parent or legal guardian.

3. Services Offered

Culture Fit Dallas offers online programs and in-person facility memberships. All class memberships include open gym access.

Online Programs

  • Self-Guided Transformation ($39/month): Full 5-day workout program, macro calculator, weekly meal plans, cardio guides, and habit tracking.
  • Coached Transformation ($99/month): Everything in Self-Guided, plus 1-on-1 accountability coaching, weekly check-ins, nutrition adjustments, and direct coach messaging.
  • Elite Hybrid Coaching ($149/month): Everything in Coached, plus 4 in-person training sessions per month, form coaching, personalized program adjustments, and body composition tracking. Add-on sessions available at $65/session.

Open Gym Memberships

  • Month-to-Month ($90/month): Open gym access, no contract.
  • Annual ($75/month, 12-month contract): Open gym access at a reduced rate, billed monthly.
  • Community Discount ($55/month): Available to teachers, students, first responders, Lovefield employees, nurses, and military members. Valid ID required. Month-to-month.
  • Day Pass ($20): Single-day open gym access.
  • Week Pass ($84): 7-day open gym access.

Class Memberships (Unlimited)

  • Grand Opening Special ($149.99/month): Unlimited classes + open gym. Available to the first 100 founding members only. Month-to-month.
  • Unlimited Classes ($205/month, 3-month contract): Standard unlimited class membership after the grand opening promotion. Includes open gym access.

Monthly Class Packages

Classes reset each billing cycle. Unused classes do not roll over.

  • 4 Classes/Month — $87 ($21.75 per class)
  • 8 Classes/Month — $158 ($19.75 per class)
  • 12 Classes/Month — $201 ($16.75 per class)

Annual Memberships

  • Gold | 1 Year — $1,788 (12-month contract): 30 classes per month + open gym + 3 VIP guest passes per month.
  • Diamond VIP | 1 Year — $2,500 (12-month contract): Unlimited classes + open gym + 12 personal training sessions + monthly guest passes + 5 VIP guest passes per month.

Class Packs

Class packs expire 3 months from the date of purchase. No refunds on unused classes after expiration.

  • Single Class — $30
  • 5-Pack — $140 ($28/class)
  • 10-Pack — $260 ($26/class)
  • 20-Pack — $475 ($23.75/class)
  • 30-Pack — $675 ($22.50/class)

Personal Training Gym Access

Members training exclusively with a personal trainer receive prorated gym access at $27/month (30% of the standard monthly rate). This access is valid only during scheduled personal training sessions and does not include independent open gym use.

Service features and pricing are subject to change with reasonable notice to active members.

4. Memberships, Billing & Enrollment

Enrollment Fee

A one-time enrollment fee of $49 applies to new in-person members. This fee is waived for founding members (first 100 members or within the first 30 days of opening).

Recurring Billing

Monthly memberships and subscription plans are billed on a recurring monthly basis. By enrolling, you authorize us (or our payment processor) to charge your payment method on a monthly cycle until you cancel or your contract term ends.

Contract Terms

  • Month-to-Month: No minimum commitment. Cancel anytime before the next billing date.
  • 3-Month Contract (Unlimited Class Membership): Commits you to 3 consecutive months of billing. Early termination is subject to the remaining balance of the contract.
  • 12-Month Contract (Annual Open Gym, Gold, Diamond): Commits you to 12 consecutive months of billing. Early termination fees apply — you will owe the remaining monthly balance at the discounted rate.

Payment

Payment is due at the time of purchase or on your recurring billing date. All prices are in U.S. dollars. We reserve the right to update pricing with at least 14 days' notice to active members.

Failed Payments

If a payment fails, we may suspend facility and service access until payment is resolved. After 7 days of non-payment, we reserve the right to cancel your membership and assess any applicable early termination fees for contract-based plans.

Refunds

All membership, class pack, and pass sales are generally final. Refunds may be considered on a case-by-case basis within 7 days of initial purchase if no services have been used. Class packs and day/week passes are non-refundable once purchased. To request a refund, email culturefittx@gmail.com.

5. Cancellation Policy

Month-to-Month Plans

You may cancel at any time. Cancellation takes effect at the end of the current billing period. You retain full access until that date. No prorated refunds for partial months.

Contract Plans (3-Month & 12-Month)

Early cancellation of a contract-based plan requires written notice and payment of any remaining balance owed under the contract term. Contracts may be cancelled without penalty in the event of a documented medical condition that prevents participation, verified by a physician's note.

Annual Memberships (Gold & Diamond)

Annual memberships run for the full 12-month term. Early termination will result in a fee equal to the remaining months at the contracted monthly rate. VIP guest passes and included personal training sessions are forfeited upon early cancellation.

Online Program Plans (Elite Hybrid)

In-person sessions included in the current billing period must be used before cancellation takes effect. Unused sessions are forfeited upon cancellation and are non-refundable.

How to Cancel

Email culturefittx@gmail.com with your full name and the subject line "Cancellation Request." Cancellations are not accepted via social media or verbal notice.

6. Health & Fitness Disclaimer

Important: The fitness programs, nutrition guidance, and information provided by Culture Fit Dallas are for general informational and educational purposes. They are not a substitute for professional medical advice, diagnosis, or treatment.

By using our services, you acknowledge and agree that:

  • You should consult a qualified healthcare provider before starting any new exercise or nutrition program, especially if you have a pre-existing medical condition, injury, or health concern.
  • Physical exercise carries inherent risks, including but not limited to muscle strain, injury, and cardiovascular stress. You assume all risk associated with your participation.
  • CultureFit Dallas coaches are fitness professionals, not licensed physicians, dietitians, or therapists. Coaching advice does not constitute medical advice.
  • Results vary based on individual effort, adherence, genetics, and other factors. We make no guarantees of specific results.

7. User Responsibilities

By using our services, you agree to:

  • Provide accurate and truthful information during onboarding and check-ins
  • Use the program materials solely for your personal, non-commercial use
  • Not share, resell, or distribute any program content, workouts, meal plans, or materials
  • Treat coaches and staff with respect in all communications
  • Notify your coach of any injuries or health changes that may affect your program

We reserve the right to terminate your account without refund if you violate these responsibilities or engage in abusive, harassing, or fraudulent behavior.

8. Intellectual Property

All content provided through Culture Fit Dallas — including but not limited to workout programs, meal plans, written materials, videos, graphics, and website design — is the exclusive property of Culture Fit Dallas and Pierre Brown, protected by copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use program materials solely for your personal fitness use during your active subscription. You may not copy, reproduce, distribute, modify, or create derivative works from our content without prior written permission.

9. In-Person Facility Rules & Policies

The following rules apply to all members using Culture Fit Dallas facilities, including open gym, group fitness classes, and personal training sessions.

Open Gym

  • Open gym access is included with all class memberships and available as a standalone membership.
  • Members must check in upon arrival. Guests must be accompanied by a member with a valid VIP guest pass.
  • Re-rack all weights and return equipment to its designated location after use.
  • Wipe down equipment before and after use.
  • Culture Fit Dallas is not responsible for lost, stolen, or damaged personal property.

Group Fitness Classes

  • Classes must be reserved in advance through our scheduling system. Walk-ins are accommodated on a space-available basis only.
  • Late cancellations (under 4 hours before class) or no-shows will result in forfeiture of that class credit for monthly package holders. Class pack holders will have the class deducted.
  • Arrive at least 5 minutes before class. Doors may be closed once class begins to avoid disruption.
  • Follow all instructor directions during class. Modifications are available — notify your instructor of any injuries before class starts.
  • Class credits from monthly packages reset each billing cycle and do not roll over. Class pack credits expire 3 months from purchase.

Personal Training Sessions

  • Sessions must be scheduled in advance by coordinating directly with your trainer.
  • Provide at least 24 hours' notice to cancel or reschedule. Late cancellations (under 24 hours) or no-shows will result in forfeiture of that session.
  • Personal Training gym access ($27/month) is valid only during scheduled sessions with your trainer and does not include independent open gym use.
  • Diamond VIP members' included personal training sessions (12/year) must be used within the 12-month contract term and do not carry over.

VIP Guest Passes

  • Gold members receive 3 VIP guest passes per month; Diamond members receive 5 per month.
  • Guest passes are non-transferable, cannot be sold, and reset each billing cycle. Unused passes do not roll over.
  • The member is responsible for their guest's conduct and compliance with all facility rules.

General Conduct

  • Appropriate athletic attire and closed-toe shoes are required at all times on the gym floor.
  • Harassment, intimidation, or disrespectful behavior toward staff or other members will result in immediate membership termination without refund.
  • Culture Fit Dallas reserves the right to refuse service or revoke membership for violations of these rules.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Culture Fit Dallas and Pierre Brown shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

  • Physical injury or health complications resulting from exercise
  • Loss of data or progress information
  • Interruption or unavailability of services
  • Failure to achieve desired fitness results

Our total liability to you for any claim shall not exceed the amount you paid to us in the 30 days preceding the claim.

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify, defend, and hold harmless Culture Fit Dallas and Pierre Brown from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Dallas County, Texas.

14. Changes to These Terms

We reserve the right to update these Terms of Service at any time. When we do, we will revise the "Last updated" date at the top of this page. We will notify active subscribers of material changes via email at least 14 days before they take effect. Continued use of our services after changes take effect constitutes your acceptance of the revised Terms.
